  • Images: Obviously being a photographic business we also create and manage images as per our contractual agreement(s). We will also record a date of birth for all persons we photograph under the age of 13 and require the parent or a legal guardian to consent to photography
  • Clients and Wedding Guests Captured in Photos: Under GDPR legislation, a photograph may in some instances constitute a form of personal data where they can be processed to allow “the unique identification or authentication of a natural person”. Mark Cox Photography will never photograph an individual as a means of unique identification or authentication unless contracted to do so. Guests who attend a wedding are likely to appear in photos taken by Mark Cox Photography as a part of the visual recording of the event in photos. Guests captured in portraits or in group photos do so as part of the event and their rights are protected by Mark Cox Photography as detailed in this privacy policy. In terms of explicit GDPR compliance, Wedding clients and guests are photographed within the parameters of GDPR legislation on the basis of ‘legitimate interests’. The taking of photographs of wedding guests when viewed as a form of processing personal data is necessary for the legitimate interests of Mark Cox Photography as a photography business unless there is a good reason to protect a given individual’s personal data which overrides those legitimate interests. Operating within the parameters of legitimate interests as laid out in GDPR legislation, the disproportionate effort involved in providing privacy policy information to all wedding guests at the event and the degree to which it would distract us from performing our job renders it infeasible to do. Wedding clients are therefore requested in their contract to direct their guests to read this privacy policy in advance of the event and to advise them to contact us in advance with any concerns around the processing of their personal data, namely being photographed.
  • Sensitive Data: We do not collect any Sensitive Data about you. Sensitive data refers to data that includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data. We do not collect any information about criminal convictions and offences.
  • Where we are required to collect personal data by law, or under the terms of the contract between us and you do not provide us with that data when requested, we may not be able to perform the contract (for example, to deliver goods or services to you). If you don’t provide us with the requested data, we may have to cancel a product or service you have ordered but if we do, we will notify you at the time.

Our lawful ground of processing your personal data to send you marketing communications is either your consent or our legitimate interests (namely to grow our business).

DISCLOSURES OF YOUR PERSONAL DATA

We take your privacy very seriously. We do not sell your data to third party organisations. There are a few scenarios where some of your data may be shared with third parties to allow me to provide our services to you.

These include:

  • Software, Payment and Process Providers. We use various software and third party providers for; Customer Relationship Management (CRM), Online Orders, Payment Processing and Workflow / Process management. When choosing these providers, we have made sure that your data will only be used for the stated purpose, and that they will not be carrying out further processing or sharing your data with third parties.
  • Manufacturers (our printing labs) if we are sending an order directly to you from a lab.

  • Law Enforcement and Legal Requirements: We will provide data to law enforcement agencies if issued with a court order to do so.
  • Service providers who provide IT and system administration services.
  • Professional advisers including lawyers, bankers, auditors and insurers
  • Government bodies that require us to report processing activities.

We require all third parties to whom we transfer your data to respect the security of your personal data and to treat it in accordance with the law. We only allow such third parties to process your personal data for specified purposes and in accordance with our instructions.

INTERNATIONAL TRANSFERS

We have procedures in place to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach if we are legally required to.

DATA RETENTION

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

When deciding what the correct time is to keep the data for we look at its amount, nature and sensitivity, potential risk of harm from unauthorised use or disclosure, the processing purposes, if these can be achieved by other means and legal requirements.

For tax purposes the law requires us to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for six years after they stop being customers.

Images which have been taken during photo shoots that have the accompanying GDPR compliant consent for use on promotional material for Mark Cox Photography are kept indefinitely.

Images which have been taken during photo shoots that do have the accompanying GDPR compliant consent for use on promotional material for Mark Cox Photography will be kept for 6 months after the date of the shoot. After which time they will be deleted.

In some circumstances we may anonymise your personal data for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

YOUR LEGAL RIGHTS

Under data protection laws you have rights in relation to your personal data that include the right to request access, correction, erasure, restriction, transfer, to object to processing, to portability of data and (where the lawful ground of processing is consent) to withdraw consent.
